How to File for Divorce using the Divorce Petition:

If you are using an attorney: He/she will file for you. Your ex will be given 30 days to respond (or some number set by the county you live in). You will go to court for a hearing. If your divorce is uncontested and you agree on the property division, then your process will be quicker and easier, and also less costly in the long run!



If you are doing a self divorce, or a pro se divorce, You will file the paperwork with the courthouse in the county you live in, Your ex will be given 30 days to respond (or some number set by the county you live in). You will go to court for a hearing.

The divorce petition could also be called a Divorce Complaint.

Your ex will need to file a form concerning military service, and respond to the complaint. Also, if your ex cannot be located, there are forms for you file that notify the court of that situation. The ex is in default if he/she does not answer your Petition.
